This Privacy Policy is provided by Sage Health Labs Inc, a Delaware corporation doing business as (“DBA”) Swell (“Company,” “we,” “our,” or “us”).
Information we collect
To make Swell work, we collect:
- Basic account information (email, registration date)
- Your progress within the app
- Usage patterns (which features you use, and when)
Cookies and tracking
Our website uses only essential cookies — small data files needed to keep you signed in and remember basic preferences. We do not use third-party analytics, advertising trackers, or cross-site tracking technologies, and we do not sell or share information about your browsing activity. The Swell mobile app does not use browser cookies; standard device identifiers used to make the app function are covered under “Information we collect” above.
How we use your information
We use this data to:
- Provide you with personalized coaching and support
- Send you notifications, reminders, and updates about new app features and improvements
- Ensure the platform is working properly
How we share your information
We do not:
- Sell your data to anyone
- Use your information for advertising
- Provide access to third parties (except for essential infrastructure like our secure cloud hosting or private LLM models)
How we protect your information
Your data is encrypted both when it's traveling through the internet and when it's stored on our servers. We maintain strict security protocols and regularly audit our systems to make sure your information stays protected.
We're required to keep some data for product development, legal, and safety reasons, but we minimize what we collect and how long we keep it.
Your rights
You have the right to:
- Access your personal data
- Request corrections to your information
- Request deletion of your data (subject to certain legal requirements)
- Opt out of the service at any time
To delete your account or submit any other data request, use our Data Subject Request form.
Billing and payments
Swell is available as a monthly auto-renewing subscription. Here's what you should know:
- We do not store your payment information — all billing is handled securely through the Apple App Store or Google Play Store
- Your subscription renews automatically each month
- To avoid being charged for the next billing period, you must cancel at least 24 hours before your renewal date
- You can manage or cancel your subscription at any time through your App Store or Google Play account settings
SMS and text messages
Swell sends transactional text messages only — things like account verification codes, security alerts, and notifications tied to your account activity. We do not send marketing or promotional texts.
You opt in by entering and verifying your mobile number inside the Swell app. Because messages are sent only in response to your account activity, message frequency varies. Message and data rates may apply; check with your carrier for details. Carriers are not liable for delayed or undelivered messages.
To stop receiving messages, reply STOP to any text message. For assistance, reply HELP. You can also remove your number from your account settings at any time.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Changes to this policy
We may update this policy to reflect changes in our services or the law. We will notify you of significant changes.
Your employer can't see your conversations
If your organization is providing you with access to Swell, you might be wondering what they can see. Here's the straight answer: nothing.
Your employer cannot access:
- Your individual conversations with Swell
- What you talk about
- How often you use the app
- Any identifiable information about your sessions
We vigorously defend the anonymity of our users to ensure Swell is a safe and confidential space to engage.
What your employer can see
Your organization receives anonymized, aggregated reports that help them understand if providing Swell as a benefit to you is valuable. These reports show things like:
- Overall engagement rates (what percentage of their staff is using Swell)
- General usage trends across the entire organization
- Common themes or topics across all users (never tied to individuals)
Think of it like a survey where they see “45% of employees engaged with content about stress management” — with no way to know who those employees are.
The one exception: Swell Safe™
Swell Safe™ is our risk-detection feature. If you're in immediate danger, the system makes best efforts to detect patterns of crisis and route you to appropriate emergency resources.
What happens:If Swell Safe™ detects you may be in crisis, you'll be given crisis support information. If they've opted in, your organization may be notified that Swell Safe™ was activated and will get a message that you might benefit from a peer support or other check-in. They will not know what it was that triggered this activation, or see any details of your conversations.
Why we do this: Because getting you help in a genuine emergency is more important than anonymity. But we still protect your privacy as much as possible even in these situations.
